Do Not Be Sold Out By "Mr. Quick Money"

By: T. Robert Hill
Many people regret the day they hired a lawyer based on their desire for a quick settlement.

The “quick money” lawyer settles excellent liability cases quickly for as little as 30-40% of their fair value. He “sells out” the client for easy money to avoid having to file a lawsuit.

The insurance companies dance with glee when the “quick money” lawyer shows up representing a severely injured worker or crippled victim of a drunk driver. The insurance company knows Mr. Quick Money will not file a lawsuit, won’t investigate the case, will not review the medical evidence and has never successfully tried a lawsuit before a judge and jury.

Lawyer Quick Money’s practice is not based on honest representation of injured people but on heavy advertising, a large volume of cases, a quick “sell out” to the insurance company and a dash to his bank.

People suffering from a serious injury deserve a compassionate, experienced, hard working, well trained trial attorney who is not afraid of the insurance company or its army of lawyers.

At Hill Boren we refuse to take the quick money and sell out our clients. We take pride in our ability to obtain for our clients full and fair compensation for their injuries. We have stood with our clients for over 36 years and will continue to serve them with compassion.

Packed Passenger Vans Pose Rollover Dangers

A group of families received the phone call they never wanted to hear. Their children had been loaded onto vans for a weekend church trip and were involved in a rollover accident.

While this particular scenario may be fictional, similar accidents involving 15 passenger vans are all too common. These extended vans are frequently used by churches, schools, and universities though studies have shown that the vans does not have adequate safety features.

Passenger vans were originally designed as cargo carriers. When they were modified for people, the van became overbalanced and top heavy. When more than five people ride in the van, it becomes more likely to fishtail or flip during a sudden turn. When the van is fully loaded, it is six times more likely to rollover because of the high center of gravity.

At Hill Boren, our attorneys have the experience and legal knowledge to successfully represent even the most challenging van accident case. If you or a loved one has been the victim of a passenger van accident in Tennessee, please contact Hill Boren today.

Wal-Mart Faces Lawsuit for Poor Work Environment

By: Jeff Boyd
Wal-Mart may be known as the home of low prices, but as a result of recent lawsuits the retailer is getting an unwelcome reputation for the way it treats its employees

One lawsuit alleges that after filing claims for on-the-job injuries, three Wal-Mart employees faced either reduced hours, cut wages or demotions. One employee claims that she was forced to resign as part of her Worker’s Compensation settlement. This suit also claims that many employees fail to file injury reports and workers compensation claims because of Wal-Mart ’s retaliatory behavior.

The world’s largest retail chain and the nation’s top employer also faces allegations that the company is cheating workers out of overtime. Reports indicate that Wal-Mart is fighting 38 different state and federal lawsuits filed by hourly workers in 30 states, accusing the company of systematically forcing them to work long hours off the clock in an effort to cut costs and undersell competitors.

In a similar case, a California court found Wal-Mart guilty of breaking a state labor law requiring employers to allow 30-minute unpaid lunch breaks to employees working shifts longer than 6 hours. The class of plaintiffs numbering 116,000 was awarded $207 million in general and punitive damages.

Founded in 1962, Wal-Mart operates over 4,400 discount stores throughout the United States and employs 1.7 million people. Taking on Wal-Mart or any large employer can be intimidating. That’s why you need an experienced law firm willing to assist you. At Hill Boren, we have been protecting the rights of workers for over 30 years.

You Should Not Get Sick From A Hospital

Hospital stays are intended to make patients feel better not worse. According to the New England Journal of Medicine two million patients a year get infections during their hospital stay resulting in 90,000 deaths.

The most common types of infections acquired in hospitals are urinary tract infections, wound infections, staff infections and pneumonia. The latter two can prove to be the most deadly. Pneumonia can cause acute respiratory failure and staph infections can enter the blood stream and attack organs. Patients on ventilators, IV’s and recovering from surgery are at highest risk.

Infections can be caused by unclean hands, contaminated medical equipment, and visitors. The majority of these infections are preventable by enforcing and practicing proper sanitary practices. Most experts agree that the number one way to prevent hospital acquired infections is for health care workers to wash their hands. Other practices include sterilization of medical equipment, improved ventilation systems in operating rooms, and testing new patients to determine if they are carrying antibiotic-resistant infections (and isolating them, if necessary).

If you think a hospital acquired infection caused a member of your family to become seriously ill or die, call an experienced medical malpractice lawyer as soon as possible.

What to do When You are Injured and Hiring an Attorney?

If you have been injured because of someone else’s negligence, you may be out of work, burdened with medical bills, or in constant pain and agony. Finding an attorney can seem overwhelming. Here are some guidelines that can help you select the right personal injury lawyer, allowing you to focus on your recovery.

Does the lawyer have experience in Personal Injury Law?
Attorneys whose primary focus is personal injury law have an advantage because they understand the complexities of this practice area. At Hill Boren, we do not have a “general practice.” We devote all of our professional activities to cases involving personal injury, disability and medical malpractice.

Does the lawyer have a proven track record?
Knowing that an attorney is a proven winner in court and at the negotiating table can add to your sense of comfort and security. You do not want to be sold out by an attorney who settles quickly.

How does the attorney want to be paid?
In the personal injury and disability fields of the law, most fees depend upon the amount recovered. In workers' compensation cases the fee is generally 20% of the total recovery. Fees for other cases vary depending on their difficulty and other factors. In addition, the lawyer is reimbursed for out-of-pocket expenses.

Dealing with a personal injury, job loss, medical bills, and the resulting stress and anxiety can be overwhelming. Selecting a personal injury attorney who is experienced, skilled, and compassionate can relieve some immediate stress and give you hope for a brighter future.
